An Ivybridge Fathers 4 Justice protester from Devon has come down from the roof of a judge's house after a two-day protest. Jolly Stanesby, 39, dressed as Father Christmas and clambered on to the roof of judge David Tyzack's country home early on Tuesday morning. On Thursday, he agreed to come down from the roof, where he endured rain, cold and high winds. He was helped down by Devon Fire and Rescue personnel and was arrested and taken to a police station in Exeter. Mr Stanesby staged the protest following an appearance before the judge earlier this month over contact arrangements with his children. When he first went up on the roof, he was confronted by the judge carrying a shotgun. The protester said in a statement released at the start of the protest by Fathers 4 Justice: "I genuinely feared for my life this morning when the judge came out and aimed his gun at me. I turned my back and tried to lie down as low as possible on the roof." A statement from the Judicial Communications Office said: "The judge and his wife were woken at home about 7.15am by what sounded like a trapped or wounded bird on their roof. The judge accordingly took and loaded a shotgun to investigate. However, once he took a look outside, he realised it was a person on the roof. "In fact, he recognised the person from court proceedings and realised it was a Fathers 4 Justice campaigner. He immediately unloaded the gun and returned it to his house. He called the police and they attended the scene very quickly. There is no question of the judge having pointed the gun at the protester." Fathers 4 Justice spokesman Richard Adams said at the scene on Thursday: "Mr Stanesby has officially said to me that he will lodge a complaint against judge Tyzack as soon as he gets the opportunity." Mr Stanesby, who wants a change in family law on access, has previously staged previous protests on the Tamar Bridge on the Devon-Cornwall border, and on a crane in Exeter. Mr Stanesby, was detained by police yesterday afternoon on suspicion of trespass. Judge David Tyzack said that he picked up the gun after hearing a noise, thinking that he might need to dispatch an injured bird. Instead, he confronted Jolly Stanesby, a veteran Fathers4Justice campaigner.

 

Mr Stanesby, 37, said that the judge put his head out of a window and asked what he was doing on his roof. “I told him I was having a protest. I genuinely feared for my life when the judge came out and appeared to aim his gun at me,” he said.

A judge confronted a Fathers4Justice protester with a loaded shotgun yesterday after the man climbed on to the roof of his home dressed as Father Christmas.

 

Judge David Tyzack, QC, took the weapon outside because he believed there was an injured bird on his roof and he wanted to put it out of its misery, his spokesman said last night. But when the judge realised the protester, Jolly Stanesby, was the cause of the noise, he returned the gun to its locked cabinet and called the police, the spokesman added.

 

Police sealed off the area around Judge Tyzack's home in Farringdon, near Exeter, Devon, and brought in specialist rope teams as they prepared to end the protest.

 

Judge Tyzack spent the rest of the day hearing family cases at Torquay county court and was due to return home last night.

 

The Judicial Communications Office said the judge and his wife were woken at about 7.15am by what they thought was the noise of a bird trapped on top of their roof. ''Because he thought it was a bird he did get his shotgun and he did load it and took it outside," a spokesman said ''When he got outside and looked on the roof he recognised immediately the man and realised he was a protester. ''He took the gun straight back inside where he secured it and he then called the police to deal with the incident. There is absolutely no question of him pointing the gun towards this man."

 

The judge's wife Elizabeth, 56, said last night: "We were in bed when we heard a noise of movement on the roof over our bedroom. ''My husband was the brave one. He went outside with his shotgun. ''He was outside for about five minutes before he saw who it was and recognised him from court." She added that Fathers4Justice protesters had previously visited the couple's home. "They have left stickers around the place without us noticing," she said.

 

Mrs Tyzack, the mother of two grown up children, Anna, a journalist, and William, a barrister, said police had allowed her out of the house to buy milk. She added that she had no idea how the protest would be ended.

 

The judge said he had been told by the Department of Constitutional Affairs he could not comment in person. "There is plenty I would like to say but I really can't," he said.

 

The protester was dealt with by the judge in court on Nov 7 when he was refused an application for shared residence with his daughter.

 

Mr Stanesby, 37, from Plymouth, who tied himself to the chimney stack with a rope, said: "I genuinely feared for my life this morning when the judge came out. ''I turned my back and tried to lie down as low as possible on the roof."

 

The judge, who hears criminal as well as family cases on the Western Circuit, is a churchwarden at St Petrock's Church in Farringdon and helps administer two local charities.

 

Mr Stanesby said he planned to spend a week on the roof. A Fathers4Justice spokesman said: "This protest marks a renewal in a campaign of direct action against judges who block contact between children and their fathers, especially at a time of year when families should be together."

 

Police said an investigation into the judge's appearance with a shotgun would take place if a complaint was made. A spokesman said: "If a complaint is made then we are obliged to investigate. ''But the judge is on his own land and would be allowed to dispatch vermin or injured birds on that land. ''He would not have committed any firearms offences.

A JUDGE confronted a Fathers 4 Justice protester with a shotgun yesterday after the activist climbed onto his roof dressed as Santa.

 

His Honour Judge David Tyzack grabbed his weapon when Jonathan Stanesby climbed on to his £1million mansion with a banner declaring: “Put the Father back into Xmas!”

 

Stanesby, 37, claimed the judge — who has refused him access to his daughter — pointed the gun at him and demanded to know what he was doing.

 

But the 60-year-old judge denied aiming at the dad.

Dozens of police in four riot vans and six patrol cars raced to the scene and put a cordon around the house in Farringdon, near Exeter, Devon.

 

Last night Stanesby — who has taken part in numerous F4J stunts — put up a makeshift tarpaulin tent and vowed to stay on the roof for at least two days.

 

He told The Sun via mobile phone: “I feared for my life when the judge came out and appeared to aim his gun at me.

 

“I am here because I am angry with the way he has dealt with my case and I believe judges should do more to help fathers.”

 

Stanesby, of Ivybridge, Devon, is angry Judge Tyzack cut his phone contact with his daughter Rosy, eight, to ten minutes a week.

 

Last night a spokesman for the judge said: “The judge thought a bird was trapped on the roof. There is no question of him pointing the gun towards this man.” Last night, as Stanesby continued his protest, police were bringing in specialist rope teams to gain access to the roof.

 

Fathers 4 Justice said this was the start of a campaign to change the law to give dads at least 50 visits a year to their kids. Stanesby is awaiting trial charged with handcuffing himself to Children’s Minister Margaret Hodge.

This man seems determined to prove his unsuitability to the world, there must have been an original issue with his child's mother to warrant the original ruling. A lot of Xs use a sudden urge to see their offspring as a method of torment for their former partners.

good for you fathers 4 justice if i had to tell you my story from a long time back which i am a truthful and honest person with my seeing my 3 year old son at the time which today have not seen because his mum has put a lot off nonsence into is head which she commited adultry and by the judges i was made to suffer all these years. what makes me angry is i have thought about him every day and i know what this person is going through so this judge is wrong it takes two to tango also dont tar everybody with the same brush not all men are bad as well as all woman.

Let me get this right, the Judge thought there was "a bird trapped on the roof". Trapped in what?

 

So his next action was to:

a) Check first and then get a ladder and free the poor little thing.

b) Check first and then call the RSPB or RSPCA.

c) Get my gun and blow the tweeting little **** and half of my roof tiles to kingdom come

 

Sounds plausible to me.

 

This father for justice campaigner wants to thank his lucky stars he got a judge to rule over his case with the compassion, honesty and integrity expected of his trusted position.He could have ended up with a lying, upper class, animal murdering, peasant shooting twit to reside over his case.Where would he be then?

Fathers 4 justice people are parents who do not wish to break any law.but are drastically turning to measures because they are showing the world of the abuse caused by judges/sheriffs that are being committed by closed doors by the secrecy in the access courts. judges should be scrutinised as i was called a foreigner by a Scottish sheriff when i moved from England to Scotland to try and gain access to my 3rd child although i have got custody of 2 children already. I therefore got refused access to my 3rd child in Scotland and so i applaud all decent parents trying to show the world how judges/sheriffs are corrupt in the courtrooms

Everyone knows judges haven't got a clue about anything. They live in a different world to us. They think its fine to give murderers and rapists etc lame sentences that in no way reflect what they have done. It would be a completely different story if it was to happen to them. It also makes me laugh the way he had about a hundred police turn up to his house. If I rang the police to say someone was on my roof I proabably wouldn't get much help.

Speaking of issues Sandra (63): As a direct result of the fatherexclusive and gender discriminative sole-custody practices of UK's family courts and judges like David Tyzack, 90% of divorce children are routinely handed over after a divorce - like if they are CD-racks - to the sole mercy and property of their mothers. This concerns millions of British children of divorce. Half of these millions of British divorce children are then denied all contact with their fathers and his side of their families by domestic violent and child-abusing moms abusing the sole-custody powers given to them by the likes of David Tyzack. The other half of divorce children also gets excluded from their fathers and families in the sole-custody court practices but not as complete as those handed over to the above mentioned 50% domestic violent and child-abusing moms. The latter half of children at least occasionally get to see their fathers and families in socalled courtordered contact- and access arrangements of once every two weeks at the max, if possible under the family courts supervision in some sort of enclosed contact centre. Caused by these fatherexclusive sole-custody practises of the UK family courts - together with the USA - the UK now became by far the number one country and world record holder of children growing up fatherless in single mother-families (20%). Since Labour came into power the UK outnumber any other European country at least twice now when it comes to one parent single mother families.

Hi All

Excellent local TV coverage this evening and regional newspapers in the morning will be full with coverage. Photos have also been sold to at least 2 national papers so watch out for them  Latest reports say Jolly is happy and OK and settled in for a long stay so I will be heading back at first light. Thanks to everyone who turned up and especially to Richard West who got arrested at 9am and was locked up all day on a trumped up charge of impeding a police vechile on the way to an incident for driving to slow down country lanes. He was bailed at 6pm. Judge Tyzack first denied having a gun but the press phoned his wife and she said he took it out because he thought that he had a bird or fox on his roof! oops!! Perhaps she’s next !!

A fathers' rights campaigner was last night camped out in protest on the rooftop of a Westcountry judge's home.Dressed in a Santa Claus outfit, he said he was ready for an extended protest and has blankets, food, a mobile phone, a battery, and a siren with him, and has put up a makeshift tent.

 

Police cordoned off the East Devon house of Judge David Tyzack, after the Fathers 4 Justice (F4J) activist Jolly Stanesby scaled the roof at around 7.20 yesterday morning.

 

Speaking from the rooftop, Mr Stanesby, 37, of Ivybridge, South Devon, said: "I climbed up onto the roof using a few window ledges and a drainpipe.

 

"As soon as I got up there all hell broke loose - and the alarms starting ringing out.

He went on: "If this is what it take to be heard, then it has to be done. I don't know how long I'll stay - I'll wait and see, but I've got enough food to last a week and I can put up with the cold.

 

The campaigner - who has previously staged protests on the Tamar Bridge and handcuffed himself to the former children's minister Margaret Hodge - unfurled a banner that reads "Put the Father back into Xmas".

 

He said he was determined to make a stand in the run-up to Christmas over what he claims is bias in the family courts against fathers denied access to their children following a divorce or separation.

 

F4J campaigners from across the country yesterday arrived in the Westcountry to show support for Mr Stanesby, and made a brief protest outside Exeter Crown Court.

 

The group gave warning that they will target other judges with demonstrations in the coming months.

 

The actions mark a resurgence of the organisation which disbanded formally in January amid claims of a plot to kidnap the Prime Minister's five-year-old son, Leo Blair. F4J claims the allegations were bogus. Mr Stanesby said: "There are people queuing up to do things. There will definitely be demonstrations in the run-up to Christmas - and disruptions."

 

He added that F4J was no longer a "membership organisation" because it had suffered from "rogue elements and infiltrators".

 

He said that protests in future would be more selective than they had been in the past.

 

He added: "We need to mobilise things in the right way.

 

"It's a lottery the kind of treatment people get when they go before the family courts.

 

"We'll also be targeting our protests at various solicitors - locally, but on a national level as well."

 

This is not the first time Judge Tyzack's house has been targeted by F4J.

 

In the past a double decker bus complete with megaphones has made its way to the house, and Fathers 4 Justice stickers have been put over the fence and front door.

 

A police spokesman said: "The scene has been cordoned off while efforts are made to ascertain the man's intentions."

 

A 40-year-old man from Ottery St Mary was arrested nearby for willfully obstructing the highway and is in custody at Heavitree police station in Exeter.

Police are on the scene and a special negotiator has been called in to speak to the man, named by a group calling itself Fathers 4 Justice as Jolly Stanesby.

 

Mr Stanesby is a high-profile fathers' rights activist. He scaled the Judge Tyzack's roof at Glebe Lodge, Farrington, using a ladder and unfurled a banner that reads Put the Father back into Xmas. He has apparently tied himself to the chimney stack with ropes. Mr Stanesby, 37, from Ivybridge, said he had supplies to last several days and plans to spend a week on the roof. Judge Tyzack sits at Plymouth County Court on Family Cases.

 

A Fathers 4 Justice spokesman claimed it had targeted the judge because of his record for refusing fathers contact with their children. He said: "This protest marks a renewal in a campaign of direct action against judges who deliberately block contact between children and their fathers, especially at a time of year when families should be together." A judge could face police questioning after claims he aimed a gun at a member of Fathers 4 Justice who was staging a protest on his roof.

 

Judge David Tyzack was accused of brandishing the weapon at a campaigner who climbed on top of his country residence dressed as Father Christmas.

 

The campaigner, Jolly Stanesby, claims he was threatened by the judge as he unsuccessfully ordered him off the £1million property.

 

But although Judge Tyzack admits holding the gun, he insists it was because he believed an "injured bird" had landed on his roof.

 

And he says that when he realised it was a man, he put his gun away and called the police.

 

The bizarre stand-off took place early yesterday morning, after the veteran campaigner donned a Santa Claus costume, climbed on to the judge's house and unveiled a banner which read "Put the Father back into Xmas".

 

The protest deliberately targeted Judge Tyzack, who earlier this month refused Stanesby's court application for greater access to his daughter.

 

Mr Stanesby, 60, who plans to stay on top of the seven-bedroom house for "several days" said he feared for his life when the judge appeared below the roof armed with a double barrel shotgun.

 

A spokesman for the judge then blamed the initial denial on a "breakdown in communicaton" and said the judge had been carrying a gun because he thought a wounded bird had landed on their roof.

 

Peter Farr, spokesman for the Judicial Communications Office, said: "The Judge and his wife were woken at about 7.15 am by what they thought was the noise of a bird trapped on top of the roof of their house.

 

"Because he thought it was a bird he did get his shotgun and he did load it and took it outside.

 

"When he got outside and looked on the roof he recognised immediately the man and realised he was a protester.

 

"He took the gun straight back inside where he secured it and he then called the police to deal with the incident.

 

"There is absolutely no question of him pointing the gun towards this man."

 

But a spokesman for Fathers 4 Justice said the group had taken legal advice and were considering pressing charges against the judge for threatening to endanger the protestor's life.

 

Speaking from the roof in Farringdon, near Exeter, on a mobile pone, Mr Stanesby said: "I genuinely feared for my life this morning when the Judge came out and appeared to aim his gun at me.

 

"I turned my back and tried to lie down as low as possible on the roof. I am now concerned that the sheer numbers of police indicate that they intend to remove me by force which may result in a serious accident.

 

"All I want to do is to stage a peaceful protest and come down when I am ready."

 

Stanesby has been locked in a custody battle since they split in six years ago.

 

The couple's daughter lives with her mum in Devon and sees her father every other weekend.

 

Last night the mother described Stanesby's rooftop antics as "totally unnecessary" and said: "He just likes drawing attention to himself.

 

"He likes being on the news, climbing up cranes or whatever.

 

"It's totally unnecessary and I don't want my life displayed in this manner."

 

A Devon and Cornwall spokesman said last night that an investigation into the incident involving Judge Tyzack and Mr Stanesby would be launched if a complaint is made.

 

The spokesman said: "If a complaint is made then we are obliged to investigate. But the judge is on his own land and would be allowed to despatch vermin or injured birds on that land.

 

"He would not have committed any firearms offences."

 

In August 2005 Stanesby was given a 12-month conditional discharge at Newport Crown Court after he joined three campaigners waving a banner from a gantry across the Severn Bridge.

 

As well as handcuffing himself to the former children's minister Margaret Hodge, he also had to be brought down from a crane in Exeter and a gantry over Tamar Bridge.

 

If charges are brought against Judge Tyzack after today's incident, it is likely to be compared to the case of Norfolk farmer Tony Martin, who was jailed for murder after opening fire on burglar Fred Barras in August 1999.

 

The conviction was reduced to manslaughter on appeal and Martin was released in 2003 after a debate about property owners' rights to tackle intruders.

It does seem to be overkill to go to the bother of unlocking a gun cabinet, rushing outside and loading the gun because an injured bird ( with clogs on? ) was supposedly making a noise on your roof! Why would any sane person try and remove an injured bird from a roof with a shotgun which is likely to damage the property than an injured bird? Someone who is highly paid to make fair and balanced decisions on a daily basis through their profession appears to have made an appalling decision in this case.

When will the authorities realise they have no right to steal people's children (unless parents have broken the law)? This fight will never end until legislation is changed to prevent anything but shared parenting, except in cases of evidential abuse. Children are routinely taken from good parents for no reason and people won't wake up to the fact that this can and does, happen to anyone, anywhere, whatever/whomever you are.

Father Christmas camps out – on roof of judge's house

A FATHERS 4 Justice protester dressed as Father Christmas was last night on the roof of a judge's home.

 

Police failed to talk down activist Jolly Stanesby, 39, who clambered onto the roof of Judge David Tyzack's Devon home at around 7.30am.

 

As darkness fell last night, a police spokesman said: "He has set up his tent on the roof.
"He is having a picnic and has got his radio on."

 

Devon and Cornwall Police have thrown a cordon around the house.

 

Fathers 4 Justice spokesman Richard Adams said the judge was there as Mr Stanesby went on the roof this morning, setting off all the alarms.

 

Mr Stanesby, from Ivybridge, Devon, staged the protest following an appearance before the judge earlier this month over contact arrangements with his children.

 

The activist, who wants a change in family law on access, said he plans to spend a week on the roof of the judge's house near Exeter.

 

Mr Stanesby, who at one stage was sitting astride the chimney, unfurled a banner that read 'Put the Father back into Xmas'.

 

Five protesters from the re-launched protest group also staged a peaceful demonstration outside Exeter Crown Court during the day.

 

A Fathers 4 Justice spokesman said: "Judge Tyzack is one of the UK's worst judicial offenders when it comes to refusing fathers contact with their children.

 

"This protest marks a renewal in a campaign of direct action against judges who deliberately block contact between children and their fathers, especially at a time of year when families should be together."

 

Devon and Cornwall police cordoned off the house, and arrested a member of the protest group for obstructing the highway.

 

Fathers 4 Justice said further protests are planned at the homes of former President of the Family Division Dame Elizabeth Butler Sloss at Marsh Green, Exeter, and Mrs Justice Bracewell who owns the Lynch Country Hotel in Behind Berry in Somerset.

A protesting Father Christmas who is staging a Fathers 4 Justice protest on the roof of the house of a West Country Judge has said he is concerned about his personal safety after Police indicated they would try and remove him by force this evening.

 

Veteran activist Jolly Stanesby, aged 37, from Ivybridge, Devon plans to spend a week on the roof of Judge Tyzack who sits at Plymouth County Court on Family Cases.

 

But Police rope teams are threatening to remove the protestor. Police have now extended the cordon around the Judge¹s house to over a mile and the village of Farringdon has effectively been sealed off to the public and Fathers 4 Justice negotiators have been refused access.

 

Said Mr Stanesby speaking to F4J at 3.30pm today. “I genuinely feared for my life this morning when the Judge came out and aimed his gun at me. I turned my back and tried to lie down as low as possible on the roof. I am now concerned that the sheer numbers of police indicate that they intend to remove me by force which may result in a serious accident.”

 

“All I want to do is to stage a peaceful protest and come down when I am ready.”

 

Judge Tyzack, who has apparently denied aiming a loaded shotgun at the protestor this morning is expected to arrive home at around 6.00pm.

 

Said an F4J spokesperson, “At approximately 6.00am this morning the first of  a series of protests at Judge¹s houses in the run up to Christmas took place. Jolly Stanesby scaled on the roof of the home of Judge Tyzack. Mr Tyzack came out to see Mr Stanesby, who is known to him, on the roof unfurling a banner.”

 

“He re-entered the property and came out for a second this time with what is believed to be a double barrelled shotgun. One barrel was loaded with a cartridge and the weapon cocked and aimed at Mr Stanesby putting him in fear of his life.”

 

“We have been advised that the threat of lethal force is a serious offence and that Mr Stanesby will be asking Police to investigate. In the event that they fail to do so Fathers 4 Justice will consider other legal avenues to pursue this charge. In the event of a conviction the Judge could face a custodial sentence and loss of his firearms licence.”
